TERMS &
CONDITIONS
FOR THE SUPPLY OF HEARING SERVICES
FROM 21ST CENTURY HEARING LTD
In these conditions.
CONDITIONS means the standard terms and conditions of supply set
out in this document.
CONTRACT means the contract for the purchase and sale of hearing
aids.
HEARING AIDS means monaural or binaural hearing aids (or other products
that assists with hearing) which 21st Century Hearing Ltd is to
supply under this contract in accordance with these conditions.
PROFESSIONAL FEES means the fee of conducting and processing this
contract and arrangements as necessary with the manufacturer for
the production of Hearing aids to suit your needs.
WE/US/OUR means 21st Century Hearing Ltd. YOU means the customer
to whom we have agreed to supply Hearing Aids or services on the
front of this contract. The headings in these conditions are for
convenience only and shall not affect their interpretation.
1. Basis of sale.
We shall supply the hearing aids to you in accordance with any written
specification subject to these conditions, which shall govern the
Contract to exclusion of any other terms and conditions. No variation
to these Conditions shall be binding unless agreed in writing between
21st Century Hearing Ltd and You.
2. Supply Liabilities.
Supply of the Hearing Aids, other products or accessories shall
be made by US to YOU. Risk of damage to or loss shall pass directly
to you at delivery. If you decide to reject the supply, they will
remain at your risk until returned to and received by us in their
originally supplied condition. You are advised therefore to seek
out insurance to cover the cost of supply. We reserve the right
to limit any refund due to you, to recover our costs should the
supply be damaged or misused in any way. Notwithstanding delivery
and the passing of risk in the supply, the property in the supply
shall not pas to you until we have received in cash or cleared funds
payment in full for the supply.
3. Warranties and Liability.
3.1 Provides that nothing in these conditions shall restrict or
exclude liability for death or personal injury caused by our negligence,
or affects your statutory rights dealing as a consumer. We shall
not be liable to you by reason of any representation, or any implied
warranty, condition or other term of any duty at common law, or
under express terms of the contract, for any consequential loss
or damage whether for loss of profit or otherwise, costs, expenses,
or other claims whatsoever which arise out of or in connection with
supply. In any event our liability shall not exceed the value of
the supply, except as expressly provided in these conditions.
3.2 We shall not be liable to you or deemed to be in breach of the
contract by reason of any delay in performing, or any failure to
perform any of our obligations under these conditions, if the delay
or failure was due to any cause beyond our reasonable control.
4. Supply of Hearing Aids
In the unlikely event that despite our aftercare service, you are
not satisfied with the hearing aids, you are entitled to a full
refund if you return the hearing aids to us in their original condition
within seven days from delivery and confirm in writing that you
are cancelling the contract. Under our customer services policy,
you are also entitled to return the hearing aids up to 30 days from
delivery if you are not satisfied with the hearing aids and you
will receive a refund of the purchase price less a fee of £70
to cover our handling costs. If the hearing aids have to be returned
to the manufacturer for modification or adjustment within the 30
day initial period of supply, we will extend this period by the
number of days you are without the hearing aid. If in the unlikely
event that we decide to cancel the contract within 30 days we will
refund to you the purchase price paid by you for the hearing aids.
5. Aftercare Service
We are aware that the fitting of new hearing aids requires a period
of adjustment following the supply of hearing aids by us. You are
entitled to a further personal consultation, free of charge, within
6 weeks of supply, at a convenient time and location for you to
assess your progress and to offer any assistance that may be required.
We provide periodic hearing check ups and advice at no extra charge,
upon receiving you request for this service. .
6. Customer Service.
If you are dissatisfied with our service or if you have problems
with your hearing aids once they have been fitted, please contact
our Head Office to discuss the problems. If after contacting us
you wish to take matters further you are entitled to contact the
Hearing Aid Council in Milton Keynes. 21st Century Hearing Ltd is
registered with the Hearing Aid Council.
7. British Society of Hearing Aid Audiologists.
B.S.H.A.A. is the professional body which represents hearing aid
dispensers. They can be contacted at The Secretary, BSHAA, 9 Lukins
Drive, Great Dunmow, Essex. CM6 1XO
8. Standards of Service.
All hearing aid dispensers are required to be registered with the
Hearing Aid Council and a copy of the councils code of practice
may be seen on request. The Councils duties include ensuring
standards in dispensers conduct and competence. Their address
is the Hearing Aid Council, Witan Court, 305 Upper Fourth Street,
Central Milton Keynes. MK9 1EM
9. General.
9.1 There is nothing in these conditions that will affect your statutory
rights in relation to the Sales of Goods Act.
9.2 If any provision of these conditions is held by any competent
authority to be invalid or unenforceable in whole or in part the
validity of the provisions of these conditions and the remainder
of the provision in question shall not be affected.
9.3 The contract shall be governed by the laws of England the parties
submit to the exclusive jurisdiction of the English courts.
10. Guarantees.
Guarantees issued by the manufacturers for a Hearing Aid covers
defects in the materials/components used and production, except
for batteries and consumables such as wax filters and are valid
for a period of ________years and can be redeemed by another hearing
aid company authorised by the manufacturer. Any modification made
to the hearing aids within the period of guarantee, by any other
person/company other than by 21st Century Hearing Ltd or by the
supplying manufacturer invalidates all guarantees.
